ON
THE GRANTING OF LICENSE TO USE WRITTEN GUARANTEE CENTRALLY
FROM THE PRESIDENT DIRECTOR OF PERTAMINA (PERSERO)

THE MINISTER OF FINANCE,

Reading :

Law No. 22/2001 dated November 23, 2001 on petroleum and Natural Gas

Considering :

1. that Article 60a of Law No. 22/2001 dated November 23,2001 stipulates that with the enforcement of this law, the model of Pertamina is changed into a limited liability company (Persero) by a government regulation in a period of 2 (two) years;
2. that based on the above mentioned consideration, it is deemed necessary to issue a decision of the Director General on Written Guarantee of Pertamina in connection with the change in the model of Pertamina into state limited liability company.

In view of :

1. Law No. 10/1995 on Customs Affairs (Statute Book of 1995 No. 75, Supplement to Statute Book No. 3612);
2. Law No. 19/1997 on Collection of Tax by Distress Warrant (Statute Book of 1997 No. 42, Supplement to Statute Book No. 3686);
3. Decree of the Minister of Finance No. 234/KMK.05/1996 on Procedures for Collection of Receivables of Import Duty, Excise, Administrative Fine, Interest and Tax in the framework of the Import as already amended by Decree of the Minister of Finance No. 22/KMK.01/1999;
4. Decree of the Minister of Finance No. 147/KMK.05 on the Appointment of Officials to Collect Central Taxes, Procedures and Timetable of Realization of Collection of Tax as already amended by Decree of the Minister of Finance No. 21/KMK.01/1999;
5. Decree of the Minister of Finance No. 441/KMK.05/1999 on the Use of Written Guarantee to Guarantee the Payment of Collection of Import Duty, Excise, Administrative Fine and Taxes in the Framework of the Import;

DECIDES :

To stipulate :

THE DECISION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE ON THE GRANTING OF LICENSE TO USE WRITTEN GUARANTEE CENTRALLY FROM THE PRESIDENT DIRECTOR OF PERTAMINA (PERSERO)

FIRST :

The license to use written guarantee as guarantee at stake for the settlement of payment of import duty, excise and other taxes in the framework of the import on the import by PT Pertamina (Persero) in either upstream petroleum and natural gas, downstream petroleum and natural gas, geothermal, postponement of the payment and provisional import shall be granted to the President Director of Pertamina (Persero).

SECOND :

The license to use the written guarantee shall be granted centrally and effective as from January 1, 2006 to December 31, 2006.
